Welcome to Aurant. These Terms and Conditions ("Terms") govern your access to and use of our media management platform and services. By accessing or using Aurant, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Acceptance of Terms

By creating an account, accessing, or using Aurant, you confirm that:

  • You are at least 18 years old and have the legal capacity to enter into binding contracts
  • You have read, understood, and agree to these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and up-to-date

Service Description

Aurant provides a cloud-based media management platform that enables users to:

  • Upload, store, and organize media files securely
  • Create and manage professional portfolios
  • Collaborate with team members and clients
  • Share content through custom galleries
  • Manage projects and client relationships

We reserve the right to modify, suspend, or discontinue any feature or service at any time with or without notice.

3. Account Registration and Security

3.1 Account Creation

You must create an account to use Aurant. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

4. Subscription Plans and Payment

4.1 Pricing

We offer various subscription plans (Free, Professional, Business) with different features and storage limits. Pricing is displayed on our website and is subject to change with 30 days' notice.

4.2 Billing

  • Subscriptions are billed monthly or annually based on your selection
  • Payments are processed through Stripe, our payment processor
  • All fees are non-refundable except as required by law
  • You authorize automatic renewal unless you cancel before the renewal date

4.3 Free Trial

New users receive a 30-day free trial. Your payment method will be charged automatically after the trial unless you cancel.

4.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of your current billing period
  • No refunds are provided for partial months or unused features
  • If you downgrade, the change takes effect at the next billing cycle

5. User Content and Ownership

5.1 Your Content

You retain all ownership rights to the content you upload ("User Content"). By uploading content, you grant us a limited, worldwide, non-exclusive license to store, process, and display your content solely to provide our services.

5.2 Content Restrictions

You may not upload content that:

  • Infringes on intellectual property rights
  • Contains malware, viruses, or malicious code
  • Is illegal, harmful, threatening, abusive, or offensive
  • Violates privacy or publicity rights
  • Contains sensitive personal data without proper consent

5.3 Content Responsibility

You are solely responsible for your content and the consequences of sharing it. We do not endorse or guarantee the accuracy of user content.

5.4 Content Removal

We reserve the right to remove or refuse to store any content that violates these Terms or applicable laws without prior notice.

6. Acceptable Use Policy

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service or servers
  • Use automated systems to access the service without permission
  • Impersonate others or misrepresent affiliations
  • Collect user information without consent
  • Reverse engineer, decompile, or disassemble our software
  • Resell or redistribute the service without authorization

7. Intellectual Property

Aurant and all related trademarks, logos, designs, and materials are owned by us or our licensors. You may not use, copy, or distribute any of our intellectual property without express written permission. Our platform's software, design, and functionality are protected by copyright, trademark, and other intellectual property laws.

8. Storage Limits and Usage

Each subscription plan includes specific storage limits:

  • Free Plan: 5GB storage
  • Professional Plan: 100GB storage
  • Business Plan: 1TB storage

If you exceed your storage limit, you must upgrade your plan or delete content. We may restrict access to your account until you comply with storage limits.

9. Data Backup and Availability

While we implement backup systems and strive for 99.9% uptime, we do not guarantee uninterrupted access to our services. You are responsible for maintaining your own backups of important content. We are not liable for any data loss, even if caused by our negligence.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

Aurant is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, whether in contract, tort, or otherwise, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aurant, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these Terms.

12. Privacy and Data Protection

Your use of Aurant is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our privacy practices as described in the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved through:

  • Informal Resolution: Contact us first to resolve disputes amicably
  • Mediation: If informal resolution fails, both parties agree to mediation
  • Arbitration: Binding arbitration under South African Arbitration Foundation rules

You waive any right to participate in class action lawsuits or class-wide arbitrations.

14. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or through our platform at least 30 days before they take effect. Your continued use after changes are posted constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aurant regarding the use of our services and supersede all prior agreements.
